WHAT A CUSTODIAN ATTORNEY MEANS UNDER TEXAS BAR STANDARDS
Texas has established procedures to protect clients and ensure continuity of legal services if an attorney becomes unable to practice due to unexpected circumstances such as disability, incapacity, or death.
Under Part XIII of the Texas Rules of Disciplinary Procedure, attorneys are permitted to voluntarily designate a qualified Texas attorney to serve as a custodian attorney. This role exists to ensure that client interests remain protected and that legal matters are handled responsibly in the event of an unforeseen transition.
A custodian attorney helps maintain order, confidentiality, and professionalism, ensuring that clients are not left without direction or support during critical moments.
KEY TASKS OF A CUSTODIAN ATTORNEY
Under Texas disciplinary procedure, a custodian attorney may be responsible for:
- Examining client matters and records to determine what requires attention
- Notifying clients, courts, and relevant parties of the attorney’s cessation of practice
- Assisting clients in obtaining new counsel or facilitating orderly transitions
- Securing the proper disposition of client files, records, and client property
- Supporting the ethical administration of a law practice when necessary
These responsibilities are essential to preserving client rights, confidentiality, and continuity of representation.
